These Terms of Service (“Terms”) govern your access to and use of the Buyosh platform — our websites and mobile apps (the “Service”) operated by [Company legal name] (“Buyosh”, “we”, “us”). By creating an account or placing an order you agree to these Terms.
1. About Buyosh
Buyosh is a marketplace that connects customers with local businesses (“Businesses”) that offer food, goods, and services for pickup or delivery. Buyosh provides the technology platform; it is not the seller of the items you order.
The contract of sale for any order is between you and the Business. The Business is responsible for its listings, prices, availability, preparation, and legal compliance (including food-safety and licensing requirements).
2. Eligibility and accounts
You must be at least 18 years old, or the age of majority where you live, to create an account. You are responsible for the accuracy of your account details and for keeping your password confidential.
You are responsible for all activity under your account. Notify us promptly of any unauthorized use.
3. Orders and payments
Prices, item descriptions, and availability are set by each Business and may change. When you place an order you agree to pay the total shown, including any applicable delivery fee and taxes.
Payments, where enabled, are processed by a third-party payment provider (Tranzila). Buyosh does not store your full card details. Your use of the payment provider may be subject to its own terms.
An order is confirmed only when the Business accepts it. If a Business cannot fulfill an order, it may be cancelled and any charge reversed in accordance with the refund process below.
4. Cancellations and refunds
Whether and when an order can be cancelled, and any refund, is determined by the Business and by the order’s status. Once a Business has accepted or begun preparing an order, cancellation may not be possible.
Refund requests are handled together with the Business. Buyosh will assist in relaying and processing eligible refunds through the payment provider.
5. Delivery
Where a Business offers delivery, orders may be delivered by the Business or by a courier. Delivery is available only within the Business’s configured service area, and estimated times are not guaranteed.
You must provide an accurate delivery address and be reachable to receive the order.
6. Businesses using Buyosh
If you register a Business, you are responsible for the accuracy of your menu, prices, hours, and service area; for fulfilling accepted orders; and for complying with all laws and licenses applicable to your business, including consumer-protection, tax, and food-safety rules.
You grant Buyosh a license to display your business name, logo, and listings within the Service for the purpose of operating the marketplace.
7. Acceptable use
You agree not to misuse the Service: no unlawful, fraudulent, infringing, or abusive activity; no attempts to interfere with, probe, or reverse-engineer the platform; and no use of automated means to access the Service except as we permit.
8. Intellectual property
The Buyosh name, logo, and the software and design of the Service are owned by Buyosh or its licensors and are protected by law. These Terms do not grant you any right to use them except as necessary to use the Service.
9. Disclaimers and limitation of liability
The Service is provided “as is”. To the extent permitted by law, Buyosh disclaims warranties not expressly stated here and is not liable for the quality, safety, or legality of items sold by Businesses.
To the maximum extent permitted by law, Buyosh’s aggregate liability arising out of the Service is limited as described in this section. [Limitation-of-liability cap and carve-outs to be set with legal counsel.]
10. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or to protect the Service, its users, or the public.
11. Changes to these Terms
We may update these Terms from time to time. If we make material changes we will take reasonable steps to notify you. Your continued use after changes take effect means you accept the updated Terms.
12. Governing law
